These Terms apply to the Avisible subscription service (the "Service"). By creating an account, choosing a plan, or continuing to use the Service, you agree to these Terms. "You" means the company that holds the account. If you accept these Terms for a company, you confirm that you have the authority to bind it.
1.1 The Service is an online platform that tracks how AI assistants answer buyer questions about your brand and your competitors. Today the assistants are ChatGPT, Gemini and Google AI Overviews. Some plans include more assistants.
1.2 Within the markets and limits of your plan, the Service includes:
1.3 What each plan includes (for example markets, assistants, competitors and seats) is shown on our pricing page and in the app when you order. A market is a country and a language. If an assistant or market named in a plan is not yet available, we say so when you order, and we add it when we are able to.
1.4 The Service changes over time. We may add, change or remove features, assistants, markets and methods. AI assistants and search engines also change, and this is outside our control. If a change materially reduces what your plan includes, we tell you by email at least 30 days before it takes effect. You may then cancel as set out in section 17.3.
1.5 The Service is software. It is not a consulting, advisory or agency engagement. Work by our team needs a separate written agreement.
1.6 The Service, its reports and its emails are in English. The questions are asked in the language of each market.
1.7 Business customers only. The Service is available only to business customers acting in the course of their trade, business or profession. By signing up, you confirm that you use the Service for business purposes.
1.8 Access to the Service may be by invitation only. We may refuse or limit sign-ups, for example to prevent misuse.
2.1 To use the Service you need an account. You give us correct information about yourself, your company and your billing details, and you keep it up to date.
2.2 The person who creates the account is the account owner. The owner chooses and pays for the plan, can invite and remove users, and can cancel the subscription. The owner is responsible for the account.
2.3 Each plan includes a number of seats. A seat is one named person who has access to your account. You may invite only your own employees, contractors and advisers who need access for your business. Each person uses their own login. You may not share a login. Remove users who no longer need access.
2.4 Each invited user must accept these Terms to sign in. You are responsible for what your users do in the Service and for their compliance with these Terms.
2.5 You confirm that you have the right to give us the names and email addresses of your users.
2.6 Keep your sign-in details secure. Tell us without delay if you think someone has used your account without permission.
2.7 Our team may view your account to give support, to find and fix errors, and to keep the Service secure.
3.1 We offer different plans. Today they are Starter, Growth and Pro. Their prices and limits are shown on our pricing page and in the app.
3.2 Extra markets and add-ons. You can add extra markets and other add-ons to your plan. The price is shown when you order. Add-ons are billed in the same way as your plan, and they end when your plan ends.
3.3 Changing your plan. You can change your plan or your add-ons on the Billing page of the app. We show you how the change is charged before you confirm it.
3.4 Limits. Your plan has limits, for example on markets, seats, competitors, exports and requests through an agent connection. We may apply technical limits to keep the Service stable. We may slow down or pause use that causes unusual load.
4.1 Free trial (Starter only). When you are eligible, the Starter plan starts with 7 days free. You choose the plan and enter your payment card at checkout. We do not charge the card during the 7 days. Checkout shows the date of the first charge. If you do not cancel before that date, the subscription starts and we charge the first month.
4.2 You can cancel at any time during the trial. If you cancel before the first charge, you pay nothing.
4.3 There is one free trial for each company. A company that has already had a trial, or has been a customer before, does not get another one. We may refuse a trial if we believe it is misuse, for example if several accounts are used to get more than one trial. If you get no free days, checkout tells you before you pay that you are billed from the first day.
4.4 Growth and Pro have no free trial. They are billed from the first day.
4.5 If the trial ends without payment. If the trial ends and the payment does not succeed (for example the card is declined or removed), tracking stops. Your data stays in your account and you can still see it. You can choose a plan to start tracking again. Section 14 explains how long we keep your data.
4.6 First report. When you sign up, we may prepare a first report for your brand at no charge. We offer this once for each company. We may limit or stop it, for example to prevent misuse. You may need to choose a plan and add a payment card to open the full report. A free first report does not start a subscription and does not oblige you to pay.
5.1 Prices are in euro and exclude VAT ("+ VAT"). The price of your plan and add-ons is shown when you order.
5.2 You pay by payment card. Payment is processed by Stripe; Avisible does not receive or store your card details.
5.3 Billing in advance. The subscription is billed monthly, in advance, on the same day of each month. The first billing day is the day the paid subscription starts (after the free trial, if you have one). The subscription renews automatically each month until you cancel.
5.4 VAT. For Finnish business customers, Finnish VAT applies at the prevailing statutory rate (currently 25.5%). For VAT-registered business customers in other EU countries, the EU reverse-charge mechanism applies where you give a valid VAT number; otherwise Finnish VAT applies. For customers outside the EU, we add VAT only where the law requires it. VAT is calculated at checkout from your billing address and VAT number. You must give correct billing details.
5.5 We send a receipt or invoice by email to your billing address. Keep it up to date.
5.6 Failed payment. If a payment fails, we may try again and we may ask you to update your card. If the payment is still missing, section 8 applies.
5.7 Price changes. We may change the prices of plans and add-ons. We tell you by email at least 30 days before the new price applies. The new price applies from the first billing period that starts after that date. If you do not accept the new price, you can cancel before it applies. A price change does not change the price of a period you have already paid.
5.8 Fees are not refundable, except as set out in sections 6 and 17 and where the law requires.
6.1 You can cancel at any time. The account owner cancels on the Billing page of the app, or by email to us.
6.2 Cancellation takes effect at the end of the period you have already paid (the month). You can use the Service until then. We do not charge you again after that.
6.3 We do not refund part periods or unused time, and we do not refund add-ons that you have paid for, except where the law requires or where these Terms say otherwise.
6.4 Our right to end. We may end your subscription for any reason by giving you 30 days' notice by email. We then refund the fees you paid for the time after the end date.
6.5 Breach. Either party may end the agreement with immediate effect by written notice if the other party materially breaches these Terms and does not fix the breach within 14 days after written notice. We may end the agreement at once if you seriously breach section 7. If we end the agreement because of your breach, we do not refund fees. If you end it because of our breach, we refund the fees you paid for the time after the end date.
6.6 When the agreement ends, your access ends and section 14 applies. Sections that by their nature continue after the end (for example sections 9, 10, 12, 14, 15 and 20) continue to apply.
7.1 You may use the Service only for your own business and only as these Terms allow. You must not:
7.2 If your plan includes a connection for AI agents, you may use it only for your own business and within the limits of your plan.
7.3 If you breach this section, we may remove the content, suspend your access under section 8, or end the agreement under section 6.5.
8.1 We may suspend your access to all or part of the Service if:
8.2 For a missing payment, we first send you an email. We suspend your access only if the payment is still missing 7 days after that email. For other reasons, we tell you as early as we can, and before the suspension where this is possible and safe.
8.3 While your access is suspended, tracking may stop. Fees for the period remain due, unless the suspension was caused by our error. Your data stays in your account. We end the suspension as soon as the reason is gone.
8.4 Suspension does not limit our right to end the agreement under section 6.
9.1 Your Data. "Your Data" means the information you give us, for example your brand name and website, your competitors, your markets, the questions you add, the details of your users, and your settings. As between us, you own Your Data. You give us a licence to use Your Data to provide, support, secure and improve the Service.
9.2 Export. While your account is open, you can export or download your reports and data with the functions in the Service. After the agreement ends, you can ask us for a copy during the period in section 14.
9.3 Our materials. Avisible retains all rights in the Service and in its methodology, the question sets we write, scoring models, definitions, software, designs, templates and know-how ("Avisible Materials"). Nothing transfers ownership of these to you. You may use the question sets we write for you in the Service and in your Reports.
9.4 Reports. The reports, summaries and charts that the Service creates for you ("Reports") are part of the Service. You receive a non-exclusive licence to use the Reports internally for your own business purposes. This licence continues for Reports you have downloaded or received by email, also after the agreement ends. You may share Reports with advisers, agencies and group companies who work for you, if they keep them confidential. You may not resell, sublicense or publish the Reports as a standalone product. You may act on their recommendations freely.
9.5 Anonymised learnings. We may use anonymised, aggregated information from the use of the Service, for example to improve our services and methods and to build benchmarks. This information does not identify you, your users or your brand. We will not publish your brand as a client or quote you without your prior consent.
9.6 Third-party content. The answers shown in the Service come from third-party AI assistants. They may contain content that belongs to others. We do not own this content and we do not check it.
9.7 If you send us feedback or ideas, we may use them without payment and without any duty to you.
10.1 The Service shows how AI assistants answered the questions that we asked, on the days we asked them, in the markets and languages of your plan. AI outputs are probabilistic and change frequently and unpredictably. The same question can get different answers. The results are a sample, not a permanent state. They can differ from what you or your customers see when you ask the same question yourselves.
10.2 The Service provides information and suggestions only. It is not marketing, legal, financial or other professional advice, and we do not guarantee any specific visibility, ranking, traffic, revenue or commercial outcome.
10.3 Some texts in the Service, such as summaries and suggested actions, are written with the help of AI. They can contain mistakes. Check important facts before you act on them.
10.4 Implementation is your responsibility. Outcomes depend on factors outside our control, including third-party AI providers and search engines.
10.5 ChatGPT, Gemini, Google AI Overviews and the other assistants and services named in the Service belong to their owners. Avisible is not affiliated with them and they do not endorse the Service. An assistant may change or stop being available at any time, and the Service may change as a result (section 1.4).
11.1 The Service is provided "as is" and "as available". We work to keep it running, but we do not guarantee that it is always available or free of errors. We give no uptime guarantee and no service levels, unless we agree otherwise in writing.
11.2 We may do maintenance and updates. They can cause short interruptions. We try to do them at quiet times, and to tell you before when we expect a longer interruption.
11.3 Data for a day may be missing, for example when an AI assistant or another provider is not available.
11.4 You can reach support by email at the address in section 21. We answer on Finnish business days and use reasonable efforts to help. We do not promise response times.
11.5 We may offer new features as "beta" or "preview". They may change or be removed at any time.
12.1 Each party keeps the other's non-public information confidential and uses it only to provide or use the Service. This does not apply to information that is public, independently known, or required to be disclosed by law. Our non-public methods, question sets and scoring are our confidential information. Your Data is your confidential information.
12.2 Customer reference (you can say no, see 12.3). We may name you as an Avisible customer in our marketing, for example on our website, in presentations, in proposals and in lists of customers. For this we may show your company name and logo. You give us a free, non-exclusive right to use them for this purpose while you are a customer, and we follow any brand guidelines you send us. We do not show your results, data or reports, and we do not say that you recommend us, unless you agree to it separately in writing.
12.3 Saying no. You can stop this at any time by sending an email to the address in section 21. You do not have to give a reason. Within 30 days we stop using your name and logo in new material and remove them from our website. Material that was already printed or sent before your message can stay as it is. The same applies when your subscription ends: within 30 days we stop presenting you as a customer.
13.1 Avisible processes personal data (for example the name and email address of your account owner and users, billing contacts, and information about how the Service is used) as a controller, to provide the Service, to bill you, to keep the Service secure and to meet legal obligations. Full details are set out in our Privacy Policy at avisible.co/privacy-policy.
13.2 We may use third-party service providers to deliver and improve the Service, including payment providers, cloud hosting and infrastructure providers, email delivery providers, analytics tools, and AI service providers such as Stripe, Google, OpenAI, Anthropic, and similar technology providers. Some of these providers may process data under their own terms.
13.3 The Service is designed for public business information. We do not need personal data from you to run the tracking. Do not submit special-category personal data (section 7.1(e)). If you believe that you need a data processing agreement with us, contact us.
13.4 We keep account and billing data while your subscription is active, and after that for as long as required by applicable accounting, tax and legal obligations. We keep Your Data as set out in section 14. You have rights of access, rectification, erasure, restriction, portability and objection. To use them, contact us at the address in section 21.
13.5 We send the weekly report and other service emails to your account owner and to users who have not unsubscribed. Report emails have an unsubscribe link. Billing, security and legal notices are not report emails, and we may send them even if a user has unsubscribed from reports.
14.1 When your subscription ends, or a trial ends without payment, tracking stops. Your data stays in your account for the period in 14.2. You can choose a plan again to continue where you stopped.
14.2 We keep Your Data for 90 days after the date on which the agreement ends or tracking stops. During this time you can export your data, ask us for a copy, or choose a plan again.
14.3 After the 90 days, we delete Your Data, including the answers we tracked for you, from our active systems. Copies in backups are deleted in the normal backup cycle.
14.4 We may keep:
14.5 You can ask us to delete Your Data earlier. We will do so unless the law requires us to keep it.
15.1 Nothing limits liability that cannot be limited by law (for example for death, personal injury, fraud, or intent or gross negligence).
15.2 Subject to 15.1, Avisible's total aggregate liability arising out of or in connection with the Service, regardless of the legal basis of the claim (whether in contract, tort, negligence or otherwise), is limited to the fees you paid to Avisible for the Service in the twelve (12) months before the event that gave rise to the claim.
15.3 We are not liable for indirect or consequential losses, including lost profits, lost revenue, lost goodwill, or business interruption.
15.4 We are not responsible for what third-party AI assistants and search engines answer, or for changes in them.
15.5 Time limit for claims. Any claim arising out of or in connection with the Service must be notified to us in writing within twelve (12) months after you knew, or should have known, about the event that gave rise to it. Claims notified after that period are time-barred.
16.1 Neither party shall be liable for any delay or failure to perform caused by circumstances beyond its reasonable control, including (without limitation) failures of third-party AI providers or hosting, network or power outages, strikes, or governmental measures. Affected obligations are suspended for the duration of the event.
17.1 We may update these Terms. We tell you by email to the account owner at least 30 days before the changes take effect. The email states the date and the main changes. The new version is also on our website.
17.2 If you continue to use the Service after that date, you accept the new Terms. A change that the law requires, or that is urgently needed for security, may take effect sooner.
17.3 If you do not accept a change to these Terms, or a material reduction of the Service as described in section 1.4, you can cancel by written notice before the change takes effect. The cancellation then takes effect on the day the change takes effect, and we refund the fees you paid for the time after that day. This is an exception to section 6.3. For price changes, section 5.7 applies.
18.1 We may transfer this agreement, with all our rights and duties, to a company in the same group as Capefinn Oy, or to a successor that takes over the business of the Service.
18.2 We tell you by email at least 30 days before the transfer takes effect. The notice names the new company. The new company takes over all our duties under these Terms, including our duties on data protection and confidentiality. Fees you have already paid stay valid. If you do not want to continue with the new company, section 17.3 applies in the same way as for a change to these Terms.
18.3 You may not transfer the agreement without our written consent.
18.4 We may use subcontractors. We remain responsible for their work.
19.1 Notices. We send notices to you by email to the address of the account owner, and we may also show them in the Service. You send notices to us at the email address in section 21. An email notice is received on the next business day after it is sent.
19.2 Whole agreement. These Terms, the order details (plan, price and add-ons) and the Privacy Policy are the whole agreement. If you and we sign a separate written agreement, it comes first.
19.3 If a part of these Terms is invalid, the rest stays valid.
19.4 If we do not use a right at once, we do not lose it.
20.1 These Terms are governed by Finnish law.
20.2 Any dispute shall be resolved by the District Court of Helsinki (Helsingin käräjäoikeus) as the court of first instance.
